It has been noted that in all of Jesus’ statements, as
recorded in the Gospels, there is no reference to Lev 18:22 or Lev 20:13.
There are two reasons for this:
1.
The texts were not re-vising the law, nor were
they restating it for an audience that had not received it.
2.
Given how volatile the social and political
situation was, the ancient world DID NOT
CARE ABOUT SEXUALITY. They cared about
ownership of progeny. Since it had been
successfully established (via Ruth and 1 and 2 Samuel) that same-gender
contracts did not automatically mean a disowning of progeny, the matter was not
one that needed clarification and restatement.
We find the matter of contractuality referenced in only one
instance in the gospels: in Luke, the
meeting with the woman at the well refers to the levirate contract (which had
already been demonstrated as a legal problem in the Tamar/Judah narrative).
